Current state of North American Gambling Law

For the past 4 years, ever since a prominent UK Gaming CEO was arrested in the US, the law concerning internet gaming in both the US and Canada has been in a state of flux. Due to a gaming “clause” snuck into a security Port bill by Bush’s Republicans, incredible pressure was put on the banking systems particularly Visa to conform. The action that the banks were ordered to take over the next 36 months was to stop allowing transactions coded as gaming from being processed through any US based banks. 

There are as many opinions as there are those holding them concerning the real reasons behind the “so called” gambling ban. We are calling it so called because with the exception of a few states like Utah, there actually isn’t a gambling ban per se. What the port bill addendum did was to crack down on the banking system that underpins online gaming finance. When I first heard about this port bill, like many others I was baffled.

“Port Bill? What was or what is that?”, many thousands of us asked. Well, it is exactly what it sounds like. Its drafted legistlation regarding security of America’s ports ( think ships and entry points ). So,  back to the point, what does a Port Bill have to do with gaming law? The truth is nothing but once this addendum regarding gaming was tacked on and pushed quickly through a senate that was unprepared, it was law irrespective of whether the proper channels were used.

So, here we are 3 almost 4 years later and what other than the overt stoppage of credit card usage has been accomplished?

- Many US players are pretending to be Canadian
- Most US online players are playing quite naturally underground
- UK Whitelisted sites have given up/sold their US customer lists
- Poker is twice the size pre Port Bill, most would agree that its simply thriving
- Each year more Vegas based Sports Betting moves to Costa Rica
- Estimated annual value of the worldwide online gambling industry, now up to $20 Billion
- Nothing to do with online gambling but Macau finally overtakes Vegas as the worlds largest gaming hub
-And my favorite – Vegas has had 3 more glorious years to figure out how to jump on the online gaming bandwagon.

Ok, so all of that is old. Let’s look at what’s new.

Calvin Eyre admits on a nationally televised and syndicated TV show that he has sold his [Billion Dollar] gaming interests to the Kawanakee group at the Mohawk Indian reserve just outside of Montreal.

British Columbia admitted it couldn’t stop the hundreds of millions of dollars going overseas and in a rare show of unity simply  approved online gaming – once its done at their own online facility ( No, we are not going to tell you the name, lol ). Thus becoming the first province/state in North America to legalize gambling.

Then on August 7th the Ontario Government admits that it too might follow British Columbia’s lead as the “…US and other jurisdictions are eyeing the payoff from legalized online gaming.”
Provincial Premier, Dalton McGinty admits, “… in a perfect world Ontario would have not had to rely on gambling revenue at all, but he acknowledges the government needs the cash.

In the meantime, on the US front, on August 10th it was reported that Representative Barney Frank is now closer to bringing his online gambling legislation before the entire House, after picking up his seventieth co-sponsor for the bill. Rep. John Campbell who  signed on at the end of July.

The past couple of weeks have been good for online gamblers in the US. First, Rep. Frank held a hearing on H.R. 2267, the Internet Gambling Regulation, Consumer Protection, and Enforcement Act in which representatives both for and against the legislation spoke.

The biggest concern however is that with both republican and democratic support required and it being so close to elections, many necessary representatives who might ordinarily support the bill may be squeamish of putting their name to something that could be used against them in upcoming months.

If the bill eventually passes the House, it will still need the support of the Senate before the Unlawful Internet Gambling Enforcement Act is officially overturned. What Bush’s team sneakily attached to that Port Security Bill nearly 4 years ago is going to take the support of the full Senate to overturn.

However, Canadian Provinces breaking their historical lockstep movement with US law in a bid for closing doors on the hundreds of millions flowing outward is going to put even more fiscal pressure on the US Legislators to do something to stem the leak of billions in tax revenue.

2010 World Series of Poker- A Glance at the final table

A poker pro, a rising poker star, a wannabe poker stud…..Hey wait!! don’t get me wrong. I am none of these, but definitely one of those who do not wish to miss even a glimpse of the big ‘WORLD POKER SERIES’ each year.

November Nine and the nine players battle for the 2010 WSOP bracelet

7,319 wannabe Poker champs, indeed were seen starting the tournament this year. Left behind are only nine lucky and brilliant masterminds. The total prize pool was one of the largest in history at nearly $68.8 million. This money started being handed out at 747th place. As of right now, the current chip counts the remaining 9 players among which, 6 players are American, 2 Canadians, and 1 Italian.

Youtube Opens Up to Online Gambling in Europe… the US Still Waiting

Online gambling advertising has been banned in Youtube broadcasts for the past few years. This is because Youtube was bought by Google in 2006 and they were forced to stop publishing online casino ads in the US after a settlement with the US Department of Justice. However, news broke recently that Youtube has begun to publish gambling related ads in the United Kingdom.

The first company to get full hands into this is Ladbrokes and their ads have already started featuring on Youtube. Executives from Youtube have announced that businesses with licenses to provide online gambling services in Italy, Spain, France and the UK will be able to buy ad space.

Youtube executives also said that they will be taking measures to restrict the audience that is exposed to the online gambling related content. This means that they will block everone under 18 from watching these ads and this will be done by using the same software technology they use to prevent children from watching adult content.

This is a very good idea and it has been suggested that US advocated of online gambling freedom suggest this as a way to deal with underage irresponsible gaming. However, when this has been brought to the table in the past the opposition has argued that this measure would be insufficient but they cannot explain why this would fail for online casinos when it works so efficiently for Youtube.

Currently, the most cited of the perceived weaknesses of regulatory measures suggested to open the US online gambling market is age checking and this could be a solution for that. Sometimes itjust seems like the US authorities just refuse to see that there could be any benefits in online gambling and are in denial when solutions pop in front of them.

Chinese Government Concerned Over Underground Online Gambling Industry

We recently heard that there are some problems concerning the online gambling industry in China recently. First of all, I will say that the activity is illegal in China since the Communist party came into power in 1949. Online gambling is currently an underground activity that moves billions of dollars without anyone noticing.

The issue that arose recently is that with the start of the World Cup, there have been gambling syndicates wanting to cash in on the World Cup. The Chinese government has stated that they want to focus all of their efforts in cutting down bets for soccer because it is starting to damage the Chinese Super League, the country’s top professional poker league, and it is an illegal activity.

“The World Cup and other sporting contests will provide momentum to online gambling activities,” said Gu Jian, the deputy chief of China’s Ministry of Public Security’s Internet security division, in a media briefing.

Xu Jianzhuo, Director of Network Security Protection Service at the Public Security Investigation Agency shared his opinion on the matter and stated that in China it is easy to open your own personal gambling site and that is why the activity has spread so quickly.

I have noticed that online gambling is an activity that keeps growing very fast around the world, but the legislation problem continues to restrict online gambling operations from providing services freely. Something that I will never be able to understand is how governments do not realize that banning the activity will not make things easier for them as people in the industry have found ways to do it underground anyway so they are not helping to prevent problem gambling in any way. Instead of making online gambling illegal they should try to incorporate it to the economy and turn their citizens into responsible gamblers, I wonder how long its will take for them to do this or if they ever will.

Regulated Online Gambling Market in France

France has finalized the process of regulating online gambling within the country and they issued the first 11 licenses on June 8 to make the process official and in place. The French have designated a regulatory authority ARJEL to issue licenses for online horse racing, sports betting and poker service providers; however, online casino gambling continues to be illegal in the country.

A spokesman from ARJEL, Jean-Francois Vilotte informed that 24 companies have applied for the 35 licenses that will be issued. Out of those, 11 companies were issued 17 licenses so far and the horse racing and sports betting licensed companies can start taking bets immediately, meaning that the French are already able to place bets on the World Cup starting on June 11th. On the other hand, the poker services providers will have to wait until the end of this month to start operating as the Maltese government has filed a complaint with the European Commission which needs to be resolved previous to the beginning of poker operations.

Some of the licensees include Unibet Enterprises Ltd, which received licenses on the three categories. Everest Gaming Ltd also got a license as they operate the most popular poker room in France Everest Poker. BES SAS, owner of Bwin also was granted a license and most of the other companies which got licensed are local and focus mostly on horse racing and sports betting, even though there are a few poker ones as well.

As of today some of the companies which applied for a license have not been granted one but they have also not been rejected from the process. “Certain files of application remain in the course of instruction. There are several reasons that these applications are still under review, including the need for additional information from the applicants. The fact that these companies were not a part of the first issuance of licenses for regulated online gambling in France does not prejudge any decision on their application,” stated Vilotte at a press conference.

Among the giants of online gambling that have not been granted a license to operate in the French online gambling market is MicroGaming, they applied in conjunction with 888.com for a poker license and they are on the pending list. We will keep you updated on the licenses to come.
